Please read these terms carefully before using OzzieNetHost services. By signing up, you agree to these terms.

Important: These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", "your") and OzzieNetHost Pty Ltd ("OzzieNetHost", "we", "us", "our"), ABN 12 345 678 901, registered in New South Wales, Australia. By registering for or using any OzzieNetHost services, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Definitions and Interpretation

In these Terms, unless the context otherwise requires:

  • "Service" means the web hosting services, domain registration, email hosting, and any related products provided by OzzieNetHost.
  • "Account" means your customer account established upon registration with OzzieNetHost.
  • "Plan" means the Bronze, Silver, or Gold hosting tier you have subscribed to.
  • "Content" means any data, files, text, images, or other materials you upload, store, or transmit via our Service.
  • "Control Panel" means the web-based management interface provided for managing your hosting account.
  • "Billing Period" means the monthly or annual interval for which you pay for the Service.

2. Services and Hosting Plans

2.1 Plan Descriptions

OzzieNetHost offers three tiers of web hosting services:

  • 🥉 Bronze Plan: Designed for individuals and hobbyists. Supports up to three (3) web pages and is suited to minimal visitor traffic of up to 500 unique visitors per month. Includes 5 GB SSD storage, 10 GB bandwidth, one (1) email account, and free SSL.
  • 🥈 Silver Plan: Designed for growing personal sites and small businesses. Supports up to five (5) web pages and moderate traffic of up to 5,000 unique visitors per month. Includes 20 GB SSD storage, 50 GB bandwidth, five (5) email accounts, custom domain email, and free SSL.
  • 🥇 Gold Plan: Designed for established businesses with heavy traffic requirements. Supports up to seven (7) web pages and unlimited visitors per month. Includes 50 GB SSD storage, unlimited bandwidth, unlimited email accounts, priority support, dedicated account manager, and free SSL.

2.2 Plan Limitations

The page limits specified in each plan refer to the number of publicly accessible, unique web pages (URLs) hosted under your account. Navigation pages, landing pages, contact pages, and all other publicly accessible pages count toward this limit. Single-page applications or dynamic content pages are counted according to the number of top-level routes.

2.3 Upgrades and Downgrades

You may upgrade your plan at any time. Upgrades take effect immediately, and the cost difference is prorated for the remaining period. Downgrades take effect at the start of the next Billing Period. You agree that OzzieNetHost may automatically upgrade your plan at its discretion if your usage consistently and materially exceeds your current plan's limits, with prior notice given by email.

3. Account Registration and Security

To use our services, you must create an account by providing accurate and complete information including your full legal name, valid Australian or international contact details, and a valid email address. You warrant that all information provided is true, accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of your account password and for all activity that occurs under your account. You must immediately notify OzzieNetHost of any unauthorised use of your account at support@ozzienethost.com.au. OzzieNetHost will not be liable for any loss or damage arising from your failure to protect your login credentials.

You must be at least 18 years of age to register for an account or be an authorised representative of a legal entity. By registering, you represent that you meet this requirement.

4. Payment Terms and Billing

4.1 Fees and Payment

All prices are quoted in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. Fees are billed in advance for each Billing Period (monthly or annual) and are non-refundable except as outlined in our Refund Policy (Section 7). Payment is due on the first day of each Billing Period.

4.2 Accepted Payment Methods

We accept Visa, Mastercard, American Express, and PayPal. By providing payment details, you authorise OzzieNetHost to charge the applicable fees to your nominated payment method on a recurring basis for the duration of your subscription.

4.3 Failed Payments and Suspension

If a payment fails, we will attempt to process it again within 3 business days and notify you via email. If payment remains outstanding for more than 7 days, your account may be suspended. If outstanding for more than 30 days, your account and all associated data may be permanently deleted. OzzieNetHost accepts no liability for data loss due to non-payment.

4.4 Price Changes

OzzieNetHost reserves the right to modify pricing at any time. You will be given no less than 30 days' written notice via email of any price increase. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new pricing.

5. Acceptable Use Policy

You agree to use OzzieNetHost services only for lawful purposes and in compliance with all applicable Australian and international laws. You must not use the Service to:

  • Host, distribute, or transmit any content that is illegal, defamatory, obscene, fraudulent, or infringes upon any third party's intellectual property rights.
  • Conduct phishing, spam campaigns, denial-of-service attacks, or any other malicious activity.
  • Distribute malware, viruses, ransomware, or any other harmful software.
  • Engage in cryptocurrency mining or any resource-intensive automated processes not related to standard web serving.
  • Resell or sub-license hosting services to third parties without OzzieNetHost's express written consent.
  • Violate the privacy of any individual or collect personal information without valid consent in breach of the Australian Privacy Act 1988.
  • Host any adult content, gambling services, or illegal marketplace without express written approval from OzzieNetHost.

OzzieNetHost reserves the right to immediately suspend or terminate any account found to be in violation of this Acceptable Use Policy, without notice and without refund.

6. Service Level Agreement (SLA)

6.1 Uptime Commitment

OzzieNetHost commits to providing a monthly uptime of 99.9% for all hosting plans, measured on a calendar month basis. "Uptime" means the period during which the hosting service is fully operational and accessible. This commitment excludes scheduled maintenance windows, force majeure events, and outages caused by customer actions or third-party services.

6.2 Scheduled Maintenance

OzzieNetHost performs scheduled maintenance typically between 2:00 AM and 5:00 AM AEST on Sundays. We will provide at least 24 hours' notice via email and our status page for any maintenance windows that may result in service interruption.

6.3 SLA Credits

In the event that monthly uptime falls below 99.9%, eligible customers may apply for a credit as follows: downtime of 0.1%–1% results in a 5% credit; downtime of 1%–5% results in a 10% credit; downtime exceeding 5% results in a 25% credit. Credits must be requested within 30 days of the incident and are applied to future invoices, not as cash refunds. Credits are the sole remedy for downtime.

7. Privacy Policy

OzzieNetHost is committed to protecting your privacy in accordance with the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs). This Privacy Policy explains how we collect, use, and protect your personal information.

7.1 Information We Collect

We collect personal information that you voluntarily provide when registering for an account, submitting a contact form, or communicating with our support team. This includes your name, email address, phone number, business name (if applicable), billing address, and payment information. We also collect technical data such as IP addresses, browser type, and usage logs for security and performance monitoring purposes.

7.2 How We Use Your Information

We use your personal information to provide and improve our services, process payments, communicate with you about your account and service updates, comply with legal obligations, and detect and prevent fraud and security incidents. We do not sell, rent, or share your personal information with third parties for marketing purposes.

7.3 Data Storage and Security

All customer data is stored exclusively on servers located in Australia. We implement industry-standard security measures including SSL/TLS encryption, two-factor authentication options, regular security audits, and access controls to protect your personal information from unauthorised access, disclosure, or misuse.

7.4 Your Rights

You have the right to access, correct, or request deletion of your personal information held by OzzieNetHost. To exercise these rights, contact us at privacy@ozzienethost.com.au. We will respond within 30 days. You also have the right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC) if you believe we have violated the Privacy Act.

7.5 Cookies

Our website uses cookies to enhance your browsing experience, remember your preferences, and analyse site usage. You may disable cookies in your browser settings; however, this may affect certain functionality. By continuing to use our website, you consent to our use of cookies as described in this policy.

8. Refund Policy

8.1 30-Day Money-Back Guarantee

All OzzieNetHost hosting plans are covered by a 30-day money-back guarantee. If you are not satisfied with your service for any reason within the first 30 days of your initial subscription, you may request a full refund of the hosting fees paid. This guarantee applies to first-time subscribers only and does not apply to domain registration fees, which are non-refundable.

8.2 Eligibility for Refunds

To be eligible for a refund under this policy, you must submit your refund request within 30 days of your initial account activation date by emailing billing@ozzienethost.com.au with your account details and reason for cancellation. Refunds will be processed within 5–10 business days to the original payment method.

8.3 Non-Refundable Items

The following are not eligible for refund under any circumstances: domain name registrations and renewals; SSL certificate fees where separately charged; dedicated IP address fees; any plan fees after the initial 30-day guarantee period; accounts terminated due to violations of the Acceptable Use Policy.

8.4 Cancellation

You may cancel your hosting subscription at any time by logging into your control panel and selecting the cancellation option, or by contacting support. Cancellation takes effect at the end of your current Billing Period. No partial-period refunds are issued after the 30-day guarantee window has expired.

9. Intellectual Property

All content you upload to our servers remains your intellectual property. You grant OzzieNetHost a limited, non-exclusive licence to host, store, and transmit your content solely for the purpose of providing the Service. OzzieNetHost does not claim any ownership over your content.

The OzzieNetHost name, logo, website design, software, and all associated intellectual property are owned by OzzieNetHost Pty Ltd and are protected by Australian copyright and trademark law. You may not use, copy, modify, or distribute any OzzieNetHost intellectual property without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by Australian consumer law, OzzieNetHost's total liability to you for any claim arising from or related to the Service shall not exceed the total fees paid by you in the 12-month period immediately preceding the event giving rise to the claim.

OzzieNetHost is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits any rights or warranties you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded or limited by law.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any disputes arising from these Terms or the Service.

Before initiating formal legal proceedings, both parties agree to attempt in good faith to resolve any dispute through direct negotiation. If resolution cannot be reached within 30 days, either party may seek mediation through the Australian Disputes Centre prior to commencing litigation.

12. Amendments to These Terms

OzzieNetHost reserves the right to update or modify these Terms at any time. We will provide no less than 14 days' notice of any material changes by email to the address associated with your account and by posting a notice on our website. Your continued use of the Service after the effective date of the amended Terms constitutes your acceptance of the changes. If you do not agree to the amended Terms, you must cancel your subscription before the effective date.
